Australians Carbon Pollution Reduction Scheme (CPRS) is the first in the world to have included emissions from waste. In addition to reporting obligations under the National Greenhouse Emissions Reporting Act (NGER), operators of waste management facilities also have to consider the implications of emissions from waste under CPRS.
Following concerns raised by the industry during consultation on the CPRS draft legislation, it was announced on 14 May 2009 that:
“The Government has listened to those concerns and the legislation released today reflects that legacy emissions from waste will be excluded from the Scheme. Liability for landfill emissions under the Scheme will now only apply to emissions that come from waste that is deposited after the commencement of the Scheme on 1 July 2011. The delay in the commencement of the Scheme announced last week provides an extra year for the industry and local councils to prepare for the Scheme. It will also allow these parties to investigate abatement opportunities for reducing their emissions and implement measurement approaches that are best suited to their circumstances.”
The National Greenhouse and Energy Reporting System (NGERS) legislation is new and subject to ongoing development of technical determinations and regulations. Tonkin Consulting staff members have been following and actively contributing to this review and development process. Compliance with the mandatory reporting obligations under NGERS is still required even though CPRS has been delayed.
